AUTHORIZATION PURSUANT TO PARAGRAPHS 702.22(1)(a) AND 702.22(2)(a) OF THE CANADIAN AVIATION REGULATIONS

Pursuant to paragraphs 702.22(1)(a) and 702.22(2)(a) of the Canadian Aviation Regulations and after taking into account that the authorization is in the public interest and is not likely to affect aviation safety, I hereby authorize Omega Air Corporation, 4360 Agar Drive, Richmond, B.C., to conduct landings and take-offs in an aircraft within a built-up area of a city or town at a place other than an airport or a military aerodrome, and to operate a helicopter over a built-up area at altitudes and distances less than those specified in paragraph 602.14(2)(a).

Paragraph 702.22(1)(a) states that for the purpose of subsection 602.13(1), a person may conduct a take-off, approach or landing in an aircraft within a built-up area of a city or town at a place other than an airport or a military aerodrome, if the person has an authorization from the Minister or is authorized to do so in an air operator certificate.

Paragraph 702.22(2)(a) states that for the purpose of subsection 602.15(2)(a) a person may operate an aircraft over a built-up area at altitudes and distances less than those specified in paragraph 602.14(2)(a), if the person has an authorization from the Minister or is authorized to do so in an air operator certificate.

PURPOSE

The purpose of this authorization is to permit Omega Air Corporation, 4360 Agar Drive, Richmond, B.C., to conduct landings and take-offs and to operate a helicopter at altitudes of less than 1000 feet above and less than 500 feet horizontal distance from the highest obstacle within the built-up area of the Municipality of Delta and the City of Vancouver, B.C.

APPLICATION

This authorization applies only to Omega Air Corporation, 4360 Agar Drive, Richmond, B.C., when operating for the purpose of aerial photography operations for the television series "The 4400", in the Municipality of Delta and the City of Vancouver, B.C.

CONDITIONS

This authorization is subject to the following conditions:

  1. The operation shall take place on Monday, May 31, 2004, Tuesday, June 1, 2004, and Friday, June 4, 2004 between the hours of sunrise and sunset, Pacific Standard Time (PST), as per General Section of the Aeronautical Information Publication (A.I.P), depending on suitable weather conditions.
  2. Operations to/from Location 2 as under (d) below, shall take place between 06:30 and 06:45 hours PST, and 18:00 and sunset hours PST on Friday June 4, 2004 only.
  3. Operations shall be conducted within the specified hours, under day VFR conditions, using a BH06 type helicopter.
  4. The sites and routes of the operation shall be as depicted on the map submitted and held on file with Commercial and Business Aviation, Pacific Region; being:
    1. Location 1 – the intersection of Ferry Road and Captains Cove Marina, Ladner, Municipality of Delta, B.C.; and
    2. Location 2 – the front lawn of the "The 4400" production studio at 26 South West Marine Drive, City of Vancouver, B.C.
  5. The aircraft shall at all times be flown along a flight path which, in case of an engine failure or other in-flight emergency necessitating an immediate landing, shall ensure a suitable (autorotational) landing site without endangering persons or property on the ground, or on the water.
  6. The aircraft shall be flown in compliance within the "Height-Velocity" Diagram contained with the approved Aircraft Flight Manual.
  7. The aircraft shall conduct a power check immediately before commencing the operation, and the engine shall be at, or above, the manufacturers specifications.
  8. When over water beyond gliding distance from shore, all provisions of Operations Specification #45 are complied with;
  9. Operations pursuant to paragraph 702.22(2)(a) of the Canadian Aviation Regulations, operating an aircraft over a built-up area at altitudes and distances less than those specified in paragraph 602.14(2)(a), shall be confined to Location –1, as under (d) above.
  10. The height of the aircraft when engaged in flight operations at Location 1 as under (d) above, shall never be less than 100 feet above ground level (AGL), and shall be confined to the North of the intersection in question, remaining clear of the Captains Cove Marina Pub at all times.
  11. Aircraft operations at Location – 2 as under (d) above, shall be restricted to one landing and one take-off only.
  12. When landing and taking off at/from Location – 2 as under (d) above, the aircraft shall remain South of Marine Drive at all times.
  13. The arrival and departure route to/from Location – 2 as under (d) above, shall be from/to the South at all times.
  14. The approach profile to Location – 2 as under (d) above, shall be such that in the event of an engine failure, the aircraft can safely execute an autorotative landing to the designated landing site.
  15. The transit route to and from the sites/routes as under (d) above, shall be flown in accordance with Canadian Aviation Regulation 602.14, Minimum Altitude and Distances.
  16. All personnel involved shall be briefed on the operation, safety precautions and emergency procedures before flight operations commence.
  17. Persons carried on board the helicopter shall be limited to essential crew only.
  18. The aircraft shall not fly over any residential buildings, or assemblies of persons at any time.
  19. A copy of this authority shall be carried on board the aircraft while operating in Canada.
  20. The operation shall be coordinated with the appropriate Air Traffic Control authority.
  21. A co-ordinated plan for each complete operation shall be developed.
  22. The aircraft shall comply with the Commercial Air Service Standards as required under CAR 702.22(1)(b) and 702.22(2)(b).

VALIDITY
The authorization is in effect until the earliest of the following:

  1. Sunset, PST, as per General Section of the Aeronautical Information Publication (A.I.P), British Columbia, on Tuesday, June 1, 2004.
  2. the date on which any of the conditions set out in this authorization is breached; or
  3. the date on which this authorization is cancelled, in writing, by the Minister, where he is of the opinion that it is no longer in the public interest, or that it is likely to affect aviation safety.
